HC denounces role of magistrate, police over her remand

Popular film star Pori Moni was released from the Kashimpur Women’s Central Jail on Wednesday morning following her securing bail in drugs case on Tuesday.

According to Jail Superintendent Halima Khatun, Pori Moni was released around 9:20am. She was released in her lawyer Niranjana Shurovy’s custody and in presence of her uncle Jashim Uddin, said jail officials.

Fans and admirers of the celebrity actress crowded the jail gate to catch a glimpse of her walking out of prison after nearly a month. She left in a white SUV (sports utility vehicle) waving at the fans through the sunroof. She however did not answer to the questions of the reporters who were present at the scene.

Her lawyer Advocate Shurovy said the actor was not taken home on Tuesday as they could not reach Kashimpur prison within 5:30pm after completing the required formalities.

On Tuesday, a Dhaka court granted Pori Moni bail upon a bond of Tk 50,000, several days after the High Court issued a rule asking the lower court to hold her bail hearing without further delay.

Meanwhile Pori Moni told a journalist that her 27-days in police custody felt like a long nightmare.

During her interview with a journalist, Pori Moni said that the constant visits from law enforcement and media personnel at her rented flat also created problems for the other residents of the building.

In these circumstances, her landlord has asked her to leave the building premises and search for living quarters elsewhere.

About her work and future projects, Pori Moni told the journalist that she did not talk to any director regarding any films yet. She is planning to talk to directors about future projects as soon as he has settled in, she added.

In another development, the High Court (HC) strongly denounced the role of magistrate and police over putting Pori Moni on remand for three times in a case under the Narcotics Control Act. 

“It needs to be checked that what evidence the investigating officer presented with the remand pleas and the reasons why the court granted the remands," a virtual bench comprising Justice Mostafa Zaman Islam and Justice KM Zahid Sarwar said  on Wednesday during the hearing on a plea of Ain o Salish Kendra.

The court further added that it cannot happen in any civilised society. Remand is an exceptional matter.

We will give a guideline on the time frame of hearing a bail plea after it is placed before a metropolitan court, the court observation said.

On August 4 Pori Moni was shown arrested in a narcotics case, after a day she was arrested by Rapid Action Battalion (RAB).  

The lower court granted police pleas to take the popular actor on remand for three times in the same case. 

Her lawyer filed bail plea on 22 August. But the court set 13 September to hold hearing on the plea. Later, the hearing was brought forward to August 31 following an order of the High Court.
