Arrest on fake warrant still going on

Arrests on fake warrants are still going on despite directives from the higher court.

In response to a writ petition of a victim on fake arrest-warrant, the High Court some months ago issued several directives to the authorities concerned in order to stop fake arrest-warrant.

The higher court directed that the names, designations, official phone numbers of judges or magistrates and numbers of mobile phones and signatures of the court staff, who prepare arrest warrants, must be mentioned in the order of arrest-warrant so that the authenticity of the order can be verified.

Advocate Kamruzzaman, a lawyer of Dhaka, told Bangladesh Post that many innocent people are still being victims of fake arrest-warrant as the culprits, who remain behind issuance of fake warrant, don’t get punishment.

The lawyer and some other lawyers said that a section of dishonest lawyers, court employees and policemen is involved in the malpractice of making fake arrest-warrant, forging the judge’s signature. They carry out such misdeeds for personal vendetta or in exchange of huge amount of money.

They said that the victims of fake arrest-warrant don’t get any compensation for their harassment. Compensation should be provided to the victims, while stern action should be taken against the culprits in order stop the malpractice.

They also said that innocent people land in jail because of fake arrest-warrant also due to negligence of police. The High Court directed for verifying the authenticity of any order of arrest-warrant. Police should arrest any person after confirming the authenticity of warrant order, they added.

A 65-year old farmer of Narsingdi is one of the latest victims. He faced detention for four days on a fake warrant.

Abdur Rashid, son of Samir Uddin of Tarakandi village under Lebutola union at Monohardi upazila in Narsingdi, was arrested from his home on August 19. A team of police, led by sub-inspector of Monohardi Police Station Omar Faruk arrested him in an ‘attempt to murder case’, showing an arrest-warrant issued by the Dhaka Chief Metropolitan Magistrate Court.

The arrest-warrant was taken by a Narsingdi court. Later, it was sent to the Monohardi Police Station through the Narsingdi Police Super Office. Officer-in-Charge (OC) of the police station said, ‘it is really difficult for us to verify whether the arrest-warrant is fake or not.’

Talking to Bangladesh Post on Monday, Mohammad Abu Sayeed Siddiqui Tipu, a lawyer of Dhaka court who moved for the innocent man, said that police did not follow the High Court’s directive properly during the arrest of the innocent man.

The farmer was released on Monday after the court issued the release order.

The court found that there was no record of such case and no arrest warrant was issued against Abdur Rashid.

Advocate Abu Sayeed Siddiqui Tipu said that the farmer was released on Monday, as the arrest-warrant issued against him was proved fake in a Dhaka court.

Family of Abdur Rashid demanded punishment for those involved in the incident. They alleged that some of their opponents might be involved in the incident with the help of a fraudulent ring as the family is in a dispute with the opponents over land.

Md Jakir Hossain Akanda, chairman of Lebutola Union Parishad, told Bangladesh Post that such an incident is unexpected. He demanded punishment to those involved in harassing Abdur Rashid.

Enamul Huq Sagar, additional superintendent of Narsingdi police, said that police are investigating why such an incident occurred.
