The High Court (HC) on Sunday ordered the jail authorities to immediately release one Jaha Alam, who was languishing in jail for around three years in spite of being innocent.
A High Court division bench comprising Justice FRM Nazmul Ahasan and Justice KM Kamrul Kader passed the order, asking to acquit Alam from 26 graft cases, where he was wrongly implicated, reports BSS.
“We are not in support of keeping an innocent even a minute behind bars,” the court said in its order.
The court also asked Anti-Corruption Commission (ACC) to identify the persons behind the botched investigation, or else, the court has to ‘intervene’ in this.
A total of 33 cases were filed against one Abu Salek for misappropriating around Taka 18.5 crore of Sonali Bank. The ACC filed chargesheet in 26 of those cases, identifying Jaha Alam as Abu Salek.
Jaha Alam at that time went to ACC office and pleaded not guilty, saying he is not Abu Salek. His plea, however, failed to make the concerned ACC officials awake. Jaha Alam was arrested in the cases on February 6, 2016, and was being rotting in jail since then.
Recently a national daily make a report on the sufferings of Alam and Supreme Court lawyer Amit Das Gupta drew court’s attention to that.
After hearing the matter, the High Court had asked the representative of ACC chairman, the ACC official that lodged the case, representatives of home and law secretaries respectively to appeal before it today.
Today the ACC counsel acknowledged their mistake, saying after further investigation, they found out that Jaha Alam was innocent and they have pleaded before a lower court for ‘non-prosecution’.
